Terms & Conditions

The terms and conditions shown are a general statement under which Energy Audits and its employees will perform its duties when carrying out assessments and testing on domestic and non- domestic properties.

The company shall mean Energy Audits.

Agree shall mean agreed between the client and the company.

  • The assessors whilst performing their duties will operate within restrictions.

The company will initially arrange an appointment with the client. When arriving at the premises the assessor will introduce himself and show identification. The assessor will not go onto any adjoining land or property. The assessor will not move any furniture, machinery, fixtures and the like. The assessor will take measurements and readings in all rooms and record his findings in written and photographic form. Inspect the plant rooms and view the heating controls making reference to the clients manuals.

The assessor will undertake verbal communication with the client in respect of key dates e.g. when the property was constructed likewise any extensions and other significant improvements. The assessor will strive to be non intrusive at all times.

The assessment will be visual only and parts of the structure which are covered, unexposed or inaccessible will not be inspected and will not be included within the report. The assessor will not access areas which are not readily accessible owing to height or obstructions or similar.

Others are to provide safe access means

  • The survey will be undertaken within limitations and only record data specific to the assessment process.

The assessment or testing process operates within limitations and will not consider elements or structures that fall outside the appropriate methodology. An assessor will identify areas were the energy performance of the property can be improved. Recommendations will be offered and ways to improve the energy efficiency and when appropriate advise estimated costs and the associated potential cost savings.

An Energy Performance Certificate will provide the client with an energy efficiency rating for their property along with the properties impact on the environment based upon its carbon emissions.  The assessor will not comment upon defects, repairs, items of a similar nature or offer any advice on their costs.

An air tightness test will advise the client if the performance of the property complies with Part L of the Building Regulations.  Any Reports produced are designed for the sole use of the client.

  •  Conflicts of interest

Should a conflict of interest arise or pressure be applied to Energy Audits and its employees in respect of the contents or process of the assessment then we and the client reserve the right to cease the assessment  and return the instruction to the client for them to appoint another assessor. Conflicts can arise from the offer of inducements, pressure from third parties, and assessing properties owned by family and friends of Energy Audits and its employees. The relationship and nature of any possible conflict of interest will be discussed openly with all parties including the accreditation body if so required.

  •  Fees Payments and Cancellations

Payments and fees should be made in full to the surveyor on the day of the assessment, or by prior agreement, 7 days from the date shown on the invoice which will be issued on the first day of the assessment. The client agrees to pay the company the agreed fee and any disbursements.

The agreed fee is based upon the assessment carried out relative to the size and style of the property. If details have been provided by the client and it becomes apparent that the details are not reflective of the property then additional fees may apply. Should it be necessary for Energy Audits to terminate an assessment or test for reasons such as health and safety, or the client not having met the conditions required, then any subsequent re-arranged visit will incur an additional fee of £40.00.

If the appointment is cancelled by the client within 24hrs of the agreed appointment time then a cancellation fee of £40.00 would be due for payment to the company. Should Energy Audits have reason to cancel the agreed booking then notice will be given to the client and a mutually convenient time will be agreed for the re-arranged survey.

Energy Audits will not be held responsible for any losses suffered by the client as a result of a cancellation.  Fees and quotations are subject to fluctuations and are available for acceptance for a period of 7 days.

  • Late Payments

In the event of late payments Energy Audits reserve the right to charge interest on all outstanding amounts at base rate plus 8% per calendar month, or part thereof from the last date that payment was due to the date payment is made.

  • Privacy

In accordance with the Data Protection Act Energy Audits and its employees will treat the clients personnel information as private and confidential. The client however should be aware that their contact details may be used during the process of monitoring the compliance and performance of assessors.  A copy of the companies confidentiality statement is available from our website.

Energy Audits and their employees will conduct themselves in accordance with the Home Inspector Certification Limited code of conduct and the quality standards approved by BINDT and ABBE.

  • Energy Audits and its employees can not be held responsible for the security of any premises or its contents.
  • It is the clients responsibility to provide a safe environment for the assessor to work in.
  • It is the clients responsibility to ensure that Energy Audits gain access to the property at the agreed time.
  • All protection measures that are deemed necessary to carry out the assessment should be carried out by the client prior to the assessors arrival. Energy Audits can not be held responsible for any damage caused resulting from the clients failure to protect.
  • During the survey the assessor should be accompanied by a responsible person who has knowledge of the premises. Safe and clear access is to be provided to all areas.
  • Minors, unauthorised personnel and animals should be refrained from entering the survey area.
  • The client will be provided with a copy of the Terms and Conditions. The client is deemed to have accepted the contents of them.
  • The client can at any time request copies of the Confidentiality Policy Statement and Complaints Procedure which are also available from our website.
  • Energy Audits shall not be liable for any losses or damage suffered by the client as a result of the activities of Energy Audits, the contents of any reports and certificates and its obligations or events of force majeure. In any event Energy Audits liability would be limited to the amount of the fee agreed for the assessments instructed by the client
  •  Abuse

Should any employee of Energy Audits receive any form of physical or verbal abuse then the assessment would cease immediately and if appropriate legal action will be taken.
